Twelve matters scheduled for trial in September 2011 Criminal Assizes

first_img Share Share Image via: peterdaou.comAt the opening of the September 2011 Criminal Assizes this morning before Justice Bernie Stephenson-Brooks at the High Court in Roseau, twelve matters on the Cause List were given trial dates, two will be fixed for trial at a later date and counsels informed and six accused informed that they are discharged as notices of discontinuance were filed in their matter.Out of the list of twenty four are for murder, two attempted murder, two wounding with intent, one manslaughter, one burglary, one indecent assault, three who have not yet been indicted and six notices of discontinuances.In the matter involving Dexter Jno. Baptiste for the offense of wounding a warrant for his arrest has been extended as he has escaped custody and is still at large.Kevin Richards, Kessler Alcendor and Albert Steven Jr. all pleaded not guilty when a charge of attempted murder was read to them this morning. The charge filed by the Director of Public Prosecutions indicates that the accused did attempt to murder Mandella Andrew on the 26th day of December, 2008 at Bowers Lane in Goodwill. His trial has been scheduled for the 17th day of October, 2011 and the accused were all warned to appear on that date and that the terms and conditions of their bail continued.Shane Degallerie who is represented by Mrs Zena Dyer associated with Mrs. Gina Dyer-Monroe has been traversed to the January Criminal Assizes which is scheduled to commence on the 23rd of January, 2012. According to the charge read, the accused on the 23rd day of April, 2010 at Pottersville did murder Justin Joseph. The Defendant who bailed by Gale Degallerie in the sum of $30, 000.00 was informed that the terms and conditions of his bail continues and warned to return to Court on the 23rd day of January, 2012 when the January Criminal Assizes begin.Ramos Auguiste pleaded not guilty to a charge of indecent assault on the 24th day of December, 2009 which took place at Castle Bruce. Mr Auguiste who was bailed in the sum of $15, 000.00 by Sills Auguiste terms and conditions continues and was warned to return to Court on the 10th of October, 2011 when the trial is set to begin. Mr Auguiste is represented by Mr David Bruney.In the matter State vs. Stebin Valentine for the unlawfull killing of Charlesworth Christopher Junior at Portsmouth was scheduled to the 22nd day of November, 2011. He was bailed by Young Magloire of Goodwill and New Augustine of Bourne in the amount of $150, 000.00 and informed that the terms and conditions of his bail continues and also warned to appear in Court for his hearing. Mr Valentine is represented by Mrs Dawn Yearwood-Stewart.Gavin Geroge; who is remanded at the State’s Prison in Stockfarm and represented by Counsels Ms Bernadette Lambert and Mr Wayne Norde for the murder of Junior Joseph of Calibishie, trial will commence on 7th December, 2011 while Kenrick Tyson also represented by Counsels Bernadette Lambert and Wayne Norde and remanded at the State’s Prison for the murder of Cecil James of Concord will have the date of his matter fixed at a later date and his counsels informed at least seven days prior to the commencement date.In the matter involving the State and Kiwani Jackson who on the 23rd day of October, 2011 at Roseau did unlawfully wound Elsa Samuel with the intent to disfigure her is represented by Mr Glen Ducreay will also have the date for his trial fixed at a later date and his attorney informed at least seven days in advance.Johan Charles who on the 31st day of March, 2010 did enter the dwelling home of Mr Eluid Williams as a trespasser and stole $1000.00, a Toshiba laptop, 5 gold chains, 4 gold bracelets, 1 gold diamond ring, 1 wedding band, 1 gold wristlet, 3 pairs of gold earrings, 1 bottle of Johnny Walker Blue Label totaling $19, 395.00 pleaded not guilty to the charge read to him. When asked whether he had a legal representation he answered ‘No ma’am’. Ms Bernadette Lambert informed the Court that she would assist in his defense and his trial has been set for the 12th day of October, 2011. In the matter involving the State and David St. John for the unlawful murder of Clement John at Portsmouth, trial has been set for 28th November, 2011 and he is represented by Counsels Wayne Norde and Bernadette Lambert.Jachlena Spilfee Lewis who is remanded for the attempted murder of Abigail Lewis on 18th May, 2006 and represented by Mr Julien Prevost trial will commence on the 21st day of November, 2011.The Director of Public Prosecutions Mr Gene Pestaina informed the Court that Notices of Discontinuances had been filed in the matters involving Unice Joseph, Yannick Parillon, Shaphan Stuart, Kiwani Prince and Jeffrey Charles. Mr Pestaina also explained that he is not obligated to provide reasons for filing notices of discontinuance but that there are various good reasons why they were filed.
